These Terms of Service govern your use of the UpTown Cares online store, website, products, and related services. By accessing the site, creating an account, placing an order, or otherwise using our services, you agree to these Terms and to our posted Privacy Policy, Refund & Return Policy, and Shipping Policy.

1. Store use

You may use this site only for lawful purposes. You agree not to interfere with site security, misuse checkout or promotional systems, submit fraudulent information, attempt unauthorized access, or use the site in a way that violates applicable law or the rights of others.

2. Product information

We make reasonable efforts to present product descriptions, photographs, colors, features, availability, and pricing accurately. Display settings and manufacturing variations may affect appearance. We may correct errors, update information, modify products, or discontinue products when necessary.

3. Wellness and product-use information

Information on this site is provided for general product and wellness education and is not medical advice. UpTown Cares products are not represented as substitutes for professional medical diagnosis or treatment. Always follow product instructions, installation guidance, warnings, and care directions. If you have a medical condition, allergy, sensitivity, or concern about a skincare, water-contact, or wellness product, consult an appropriate qualified professional before use.

4. Orders and acceptance

Submitting an order does not guarantee acceptance. We may decline, cancel, or limit an order for legitimate reasons including inventory issues, pricing or listing errors, suspected fraud, payment problems, shipping limitations, or misuse of promotions. If we cancel an order after payment has been captured, we will provide the appropriate refund.

5. Prices, payments, and promotions

Prices are shown in U.S. dollars unless otherwise stated. Taxes and shipping charges may be added at checkout. Available payment methods are shown during checkout. Promotional codes, affiliate codes, and offers may be subject to separate conditions, eligibility rules, expiration dates, usage limits, and product restrictions. Unless expressly allowed, promotions may not be combined.

6. Shipping, returns, and refunds

Shipping timing, rates, return eligibility, refund timing, and related procedures are governed by our posted Shipping Policy and Refund & Return Policy, which are incorporated into these Terms.

7. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. Notify us promptly if you believe your account has been accessed without authorization.

The UpTown Cares name, site design, text, product presentation, graphics, photographs, logos, branding, and other content made available by us are protected by applicable intellectual-property laws. Except as permitted by law or with prior written authorization, you may not copy, reproduce, distribute, modify, sell, exploit, or create derivative works from our proprietary content.

9. User submissions and reviews

If you voluntarily submit a review, photograph, testimonial, comment, or other content to us, you represent that you have the right to submit it and that it does not violate another person's rights. Where you grant us permission to feature submitted content, we may use it for store, marketing, social, and promotional purposes consistent with that permission and applicable law.

Our store may use or link to services provided by Shopify and other third parties, including payment, shipping, analytics, affiliate, and marketing providers. Third-party services may be governed by their own terms and privacy practices. We are not responsible for third-party websites or services that we do not control.

11. Ambassador and affiliate relationships

Ambassadors and affiliates may receive compensation or commissions for qualifying referrals. Participation in the UpTown Cares ambassador or affiliate program is governed by separate program terms and agreements. Customer purchases remain subject to the store policies posted on this site.

12. Disclaimer of warranties

To the fullest extent permitted by applicable law, the site and services are provided on an "as available" basis. Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded or limited.

13. Limitation of liability

To the fullest extent permitted by law, UpTown Cares will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the site or services. Nothing in these Terms limits liability where limitation is prohibited by law.

14. Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful misuse of the site, your violation of these Terms, or your infringement of another person's rights.

15. Changes to these Terms

We may update these Terms from time to time to reflect changes in our products, services, operations, or legal obligations. The current version will be posted on this site with an updated effective date. Continued use after a revision constitutes acceptance to the extent permitted by law.

16. Governing law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.
